Further, even if the law does not require the notarization of a document, an unnotarized document has its main consequence that it will not produce legal effects against third parties, meaning those who are not parties to the unnotarized document will not be obliged to comply with the same because it is only a private document and not a public document. However, notaries public in the U.S., of which the vast majority are lay people, require only a brief training seminar and are expressly forbidden to engage in any activities that could be construed as the unlicensed practice of law unless they are also qualified attorneys.

In a dispute before a court of law, the parties can make sure that the terms in a notarized document will be followed, and the parties will not have to go through the trouble of proving each statement made therein.

Notaries in Sri Lanka are more akin to civil law notaries, their main functions are conveyancing, drafting of legal instruments, etc. They are appointed under Mobile Notary the Notaries Ordinance Pelo 1 of 1907.[22] They must pass exam held by the Ministry of Justice and apprentice under senior notary for a period of two years. Alternatively, attorneys at law who pass the conveyancing exam are also admitted as a notary public under warrant of the Minister.

Traditionally, notaries recorded matters of judicial importance as well as private transactions or events where an officially authenticated record or a document drawn up with professional skill or knowledge was required.

If the risk involved in a document is not significant, and there is no law that requires its notarization, the parties may opt not to notarize such document.

Minnesota Notary Public can only attest to the identity of a person signing a document and therefore cannot certify the authenticity of a document.

A cheaper alternative is to visit a commissioner for oaths who will charge less per signature, but that is only possible where whoever is to receive a document will recognize the signature of a commissioner for oaths.
